Tennessee Storm Victims Have Deadlines Moved to July 31

After severe thunderstorms and tornadoes raked parts of Tennessee on March 31, many of Volunteer State taxpayers could use a little good news. The Internal Revenue Service is doing its part, announcing tax relief for storm victims.

The agency announced that taxpayers and businesses in the 10 hardest-hit counties have been given until July 31, 2023, to meet a number of filing and payment deadlines, including the following:

  • April 18: income tax return filing and payment deadline
  • April 18: quarterly estimated tax payment deadline
  • April 30: quarterly payroll and excise tax return deadline
  • June 15: quarterly estimated tax payment deadline

Further, the IRS says penalties on payroll or excise tax deposits due March 31 – April 18 will be abated as long as tax deposits are made by April 18.

Which Tennessee counties are receiving this tax relief?

The expanded deadlines are available to taxpayers and businesses in the 10 Tennessee counties named in the federal disaster declaration:

  • Cannon
  • Hardeman
  • Hardin
  • Haywood
  • Lewis
  • Macon
  • McNairy
  • Rutherford
  • Tipton
  • Wayne

If any other counties are added to the disaster declaration, the IRS will automatically add them to the list of qualifying counties.

There is one caveat for those who want more time beyond the expanded July 31 deadline: extension requests from disaster-area taxpayers after April 18 and before July 31 can only be filed on paper. (See the “Extension of Time To File Your Tax Return” page on IRS.gov for more details.) 

Do taxpayers need to do anything to receive this tax relief?

Taxpayers within the disaster area do not have to do anything to receive the IRS relief measures; when they file, IRS electronic systems will apply relief measures according to the address on the return. However, any tax return that claims a loss within the disaster area due to these storms should contain the FEMA declaration number: 4701-DR.

According to the IRS, those living outside the disaster area may still be able to qualify for this tax relief if “records necessary to meet a deadline occurring during the postponement period are located in the affected area,” or they are “workers assisting the relief activities who are affiliated with a recognized government or philanthropic organization.” Unlike residents who automatically receive relief, these taxpayers need to call the IRS: 866-562-5227.

IRS Releases Reworked Form W-4

A reworked version of Form W-4 has been released by the IRS and the Treasury Department for the 2020 tax year. A number of changes were made to earlier draft versions of the form in response to complaints from tax professionals.

Accounting Today reports Treasury doesn’t expect to make further changes beyond some small inflation-adjustment updates.

The redesigned Form W-4 uses a building-block approach, replacing complex worksheets with straightforward questions, making it simpler for employees to figure withholding accurately. The new form uses the same basic information as the old design, but employs a more personalized, step-by-step approach to better accommodate taxpayers.

Accounting Today reports the redesign will not force employees to resubmit a Form W-4 simply because of the update. Employers can continue to figure withholding based on information from the most recent W-4 submitted.

Complaints from Tax Pros

The complaints about the draft version of the form, Accounting Today reports, came from accountants and tax practitioners alike, who said the draft version required taxpayers to reveal too much information to their employers about outside sources of income for employees and their spouses.

The tax reform package passed in late 2017 eliminated traditional exemptions for taxpayers and dependents along with a long list of deductions, increasing the standard exemption amounts instead. The IRS urged taxpayers to do a “paycheck checkup” last year to make sure enough was being withheld from the taxpayers’ paychecks, but few taxpayers went through the complicated process. As a result, many taxpayers found themselves owing tax because of inadequate withholding.

The IRS is urging taxpayers to do another withholding checkup this year to make sure the correct amount is withheld from their paychecks. The agency has also come out with a new Tax Withholding Estimator online tool to help.

IRS to Self-Employed Taxpayers: Use the Tax Withholding Estimator

According to the IRS, self-employed taxpayers should use the Tax Withholding Estimator when they perform their next “paycheck checkup.”

IR-2019-149 is the latest press release advertising the Tax Withholding Estimator, the agency’s newest online tool: “The estimator is an expanded, mobile-friendly online tool that replaced the Withholding Calculator, which since 2001 had offered workers an online method for checking their withholding.”

The IRS stressed that they needed to develop a new resource to help even more taxpayers manage their tax withholding: “The old calculator lacked features geared to self-employed individuals; the new estimator made changes to address this important group.”

Why Should Taxpayers Perform a Paycheck Checkup?

Tax withholding outreach was a focus of the IRS due to the implementation of the Tax Cuts and Jobs Act. As the IRS explains in Publication 5307, “the Tax Cuts and Jobs Act changed the way taxable income is calculated and reduced the tax rates on that income.” That meant “the IRS had to address and make changes to income tax withholding in response to the new law as soon as possible after it passed.”

Despite a year-long series of press releases reminding taxpayers that they might need to adjust withholding to address these changes, some tax professionals reported clients seeing surprise tax bills. Using the Tax Withholding Estimator is just one way taxpayers can avoid that problem, and accessing it is relatively easy.

How Does the New Tax Withholding Estimator Help Self-Employed Taxpayers?

The Tax Withholding Estimator helps self-employed taxpayers calculate their withholding by letting them enter information that wasn’t accepted by the old calculator: “The estimator allows a user to enter any self-employment income, including income from side gigs or the sharing economy, in addition to wages or pensions.”

Those who regularly used the old IRS Withholding Calculator will notice a number of improvements when they pull up the new Tax Withholding Estimator. Here’s the list provided by the IRS:

  • Plain language throughout to improve taxpayer understanding.
  • The ability to target either a tax due amount close to zero or a refund amount.
  • A new progress tracker to help a user know how much more information they need to enter.
  • The ability to go back and forth through the steps, correct previous entries, and skip questions that don’t apply.
  • Tips and links to help the user quickly determine if they qualify for various tax credits and deductions.
  • Automatic calculation of the taxable portion of any Social Security benefits.

Taxpayers concerned that they won’t pick the correct withholding form after getting the results of the estimator don’t need to worry. The IRS said that users will be given a link to the form corresponding to their entered information—Form W-4 for employees or Form W-4P for pensioners.

It’s Time to Get Ready for Taxes

In a matter of weeks the 2020 filing season will be underway. To help ensure that taxpayers don’t get caught unprepared, the IRS is recommending everyone to act now to avoid any tax-time surprises and ensure smooth processing of 2019 tax returns.

As part of a series of reminders, the IRS has put together a special page on IRS.gov that outlines steps taxpayers can take to get ready for the upcoming filing season. We’ll start with the basics.

Adjust Withholding

It’s a good idea to a paycheck or pension income checkup; if a taxpayer got a smaller-than-expected tax refund than expected or owed an unexpected tax bill, it’s especially important. In fact anyone who’s had a life event during the past year – a marriage, a divorce, having or adopting a child, retiring, buying a home, or starting college – should do an income checkup. Use the IRS Tax Withholding Estimator to find the best options.

If the Tax Withholding Estimator recommends a change, an employee can then submit a new Form W-4, Employee’s Withholding Allowance Certificate, to their employer. Do not send this form to the IRS.

Taxpayers who have pension or annuity income can also use the results from the estimator to complete Form W-4P, Withholding Certificate for Pension or Annuity Payments, and give it to their payer.

Taxpayers who receive a substantial amount of non-wage income should make quarterly estimated tax payments. This can include self-employment income, investment income (including gain from the sale, exchange or other disposition of virtual currency), taxable Social Security benefits and in some instances, pension and annuity income. Making estimated tax payments can also help a wage-earner cover an unexpected withholding shortfall.

Estimated tax payments are due quarterly, with the last payment for 2019 due on Jan. 15, 2020. Form 1040-ES, Estimated Tax for Individuals, has a worksheet to help figure these payments. Payment options can be found at IRS.gov/payments.

Got a part-time job in the gig economy? Workers and retirees who get self-employment income or wages from the gig economy (this includes payments in virtual currency) should make sure to include these amounts when filling out the Tax Withholding Estimator. That’s because payments received in virtual currency by independent contractors and other service providers are taxable. Self-employment rules generally apply.

In most cases, payers have to issue Form 1099-MISC, and wages paid in virtual currency are taxable to the employee, subject to withholding, and must be reported by the employer on Form W-2.

For more complex tax situations check out Publication 505, Tax Withholding and Estimated Tax. Pub 505 is also the place to go for taxpayers who owe alternative minimum tax (AMT) or various other taxes, or those with long-term capital gains or qualified dividends.

Get Organized

When it comes to taxes, nothing helps smooth the process like organization. Taxpayers should have some sort of recordkeeping system, whether electronic or paper, that keeps important information in one place. Remember that copies of filed tax returns and their supporting documents should be retained for at least three years. This includes year-end Forms W-2 from employers, Forms 1099 from banks and other payers, other income documents, records documenting all virtual currency transactions, and Forms 1095-A for those claiming the Premium Tax Credit.

It seems to be a natural instinct for taxpayers to fire off their income tax returns the minute the IRS starts accepting them, thinking it will get their refund quicker. This can actually be counter-productive. Many times these “early bird” returns are completed without all the documentation needed – like the year-end Form W-2. If a return is missing documentation, the taxpayer will have to file an amended return to make it right and the IRS says amended returns could take up to 16 weeks to transmit a refund.

The lesson here is to gather all the year-end income documents before a 2019 return is e-filed. In addition, notify the IRS of any address changes and notify the Social Security Administration of a legal name change to avoid refund delays.

Renew expiring ITINs

Taxpayers with expiring Individual Taxpayer Identification Numbers can get their ITINs renewed more quickly and avoid refund delays next year by submitting their renewal application – and doing it quickly.

An ITIN is a tax ID number used by any taxpayer who doesn’t qualify to get a Social Security number. Any ITIN with middle digits 83, 84, 85, 86 or 87 will expire at the end of this year. In addition, any ITIN not used on a tax return in the past three years will expire. ITINs with middle digits 70 through 82 that expired in 2016, 2017 or 2018 can also be renewed.

The IRS urges anyone affected to file a complete renewal application, Form W-7, Application for IRS Individual Taxpayer Identification Number, as soon as possible. Be sure to include all required ID and residency documents. Failure to do so will delay processing until the IRS receives these documents.

It takes about seven weeks from the time a completed form is filed to the time an ITIN assignment letter from the IRS is received. But that time frame expands to 9-11 weeks if an applicant waits until the peak of tax filing season to submit the form – or if the form is sent from overseas.

Taxpayers who fail to renew an ITIN before filing a tax return next year could face a delayed refund and may be ineligible for certain tax credits. Applying now will help avoid the rush as well as refund and processing delays in 2020. For more information, visit the ITIN information page on IRS.gov.

File Electronically and Use Direct Deposit

The vast majority of tax professionals already know that the fastest, most reliable way to get a tax return to the IRS is through e-filing. Whether the taxpayer employs a tax pro to do their return, or files themselves, electronic filing is the way to go.

A statement from the IRS says electronic transmission works best, no matter which direction it’s headed. “Combining Direct Deposit with electronic filing is the fastest way to get a refund. With Direct Deposit, a refund goes directly into the taxpayer’s bank account. No need to worry about a lost, stolen or undeliverable refund check. This is the same electronic transfer system used to deposit nearly 98% of all Social Security and Veterans Affairs benefits. Nearly four out of five federal tax refunds are deposited directly.”

By law, the IRS cannot issue refunds for people claiming the Earned Income Tax Credit (EITC) or Additional Child Tax Credit (ACTC) before mid-February. The law requires the IRS to hold the entire refund − even the portion not associated with EITC or ACTC. This law change, which took effect in 2017, helps ensure that taxpayers receive the refund they’re due by giving the IRS more time to detect and prevent fraud.

A word of caution about refund expectations: don’t rely on getting a refund by a certain date, especially when making a major purchase or paying bills. Some returns need additional review and may take longer to process.

For example, the IRS, along with its partners in the tax industry who serve on the Security Summit, continue to strengthen security review processes to help protect against identity theft and refund fraud. Some of these reviews may require longer to complete and therefore may delay a refund.

IRS Highlights Charity Fraud Awareness Week

Criminals pushing phishing scams impersonate a wide range of people and organizations to trick victims out of their private information and money. The seemingly endless flood of charity scams perhaps best demonstrates that there truly is no honor among thieves. Luckily, we don’t have to face identity thieves alone.

The Internal Revenue Service announced that they are taking part in Charity Fraud Awareness Week to help spread the word about this persistent threat to individuals and charitable organizations. The agency says they are “joining international organizations and other regulators in highlighting Charity Fraud Awareness Week,” which runs from October 18 to October 22 this year.

What is Charity Fraud Awareness Week?

According to the IRS, Charity Fraud Awareness Week is a campaign “run by a partnership of charities, regulators, law enforcers, and other not-for-profit stakeholders from across the world … [that] raise awareness of fraud and cybercrime affecting organizations and to create a safe space for charities and their supporters to talk about fraud and share good practice.”

How is the IRS participating in Charity Fraud Awareness Week?

The IRS is highlighting helpful resources that have been created by organizations participating in Charity Fraud Awareness Week. Specifically, the press release includes a link to a UK-based website designed to aggregate helpful information related to the campaign: PreventCharityFraud.org.uk.  

According to the IRS, this site is designed to help “[Charity Fraud Awareness Week] partners, charities, and other tax-exempt organizations and non-profits find” the following information:

  • Details about the awareness week
  • Free resources
  • A fraud pledge for organizations
  • A listing of webinars and other events held as part of the week

Data-security-awareness campaigns aren’t new to the IRS. As part of the Security Summit, the agency works year round to provide taxpayers the resources they need to avoid falling victim to myriad phishing scams. Part of that effort includes publishing their annual Dirty Dozen list of tax scams and providing online resources, like the Tax Exempt Organization Search tool.

The Tax Exempt Organization Search tool is useful in avoiding fake charity scams listing legitimate charities that are currently eligible “to receive tax-deductible charitable contributions.” The tool’s page on IRS.gov notes the types of information that can be searched for any given charity:

  • Form 990 Series Returns
  • Form 990-N (e-Postcard)
  • Pub. 78 Data
  • Automatic Revocation of Exemption List
  • Determination Letters

As for avoiding scams impersonating legitimate charities, taxpayers should stay up to date on the latest phishing scams highlighted by the IRS, Security Summit, and Charity Fraud Awareness Week partners.
